Terms of Service
Please read these Terms carefully. These Terms of Service are a binding agreement between you and NextAppt.ai and apply to both people using NextAppt.ai to find appointments and businesses using NextAppt.ai to manage listings, integrations, promotions, subscriptions, or other business features. These Terms include a binding individual arbitration provision and class-action waiver in Section 29.

1. Who These Terms Apply To
These Terms apply to everyone who accesses or uses NextAppt.ai. For clarity, we use two main categories:- Consumer Users are individuals who search for appointments, create a consumer account, request appointment alerts, save preferences, follow booking links, submit reviews or feedback, or use other consumer-facing features.
- Business Users are business owners, operators, employees, contractors, or other authorized representatives who claim, verify, manage, advertise, subscribe, integrate, or otherwise act for a business through NextAppt.ai.
2. Eligibility and Age
You must be at least 18 years old and legally capable of entering a binding contract to create or use a NextAppt account, claim or manage a business, purchase a paid feature, or otherwise accept these Terms. An adult parent or legal guardian may use NextAppt.ai to locate or arrange a service for a minor where the provider permits it. The adult is responsible for evaluating the provider, complying with the provider's rules, and avoiding unnecessary disclosure of a minor's personal or sensitive information. NextAppt.ai is not directed to children under 13.3. What NextAppt.ai Provides
NextAppt.ai is an appointment discovery, search, information, advertising, account, notification, and technology platform. Features may include appointment search, maps, filters, business profiles, claimed listings, user accounts, business accounts, saved preferences, appointment alerts, booking links, business dashboards, promotions, analytics, API or booking-platform integrations, widgets, embedded appointment advertisements, AI-assisted search or recommendations, subscriptions, lead-generation features, and future booking or payment functionality. We may add, modify, test, restrict, suspend, or discontinue features at any time, subject to applicable law.4. NextAppt.ai Is Not the Service Provider
Unless we expressly state otherwise for a particular transaction, NextAppt.ai does not provide the massage, wellness, beauty, fitness, healthcare, professional, or other appointment-based service shown on the platform. Businesses and practitioners are independent third parties. They are responsible for their own services, licensing, credentials, insurance, staffing, facilities, professional conduct, prices, taxes, cancellation policies, refunds, deposits, health or eligibility requirements, accessibility, safety, and legal compliance. NextAppt.ai does not employ, supervise, direct, or control listed providers merely because they appear on the platform, are verified, purchase a subscription, use an integration, or receive leads from NextAppt.ai.5. Appointment Availability and No Reservation Guarantee
Appointment information can change rapidly. Availability may come from a business, a third-party booking platform, an API or integration, publicly available information, recent system checks, cached data, or lawful automated processing. NextAppt.ai may label availability as confirmed, inferred, estimated, recently checked, fresh, available, or with similar language. A confirmed label generally means a source showed that opening during a recent successful check; it does not guarantee the opening remains available. Inferred or estimated availability may be calculated from related service availability, duration rules, schedule patterns, or other information and may not have been directly confirmed by the provider. An appointment is not reserved merely because it appears on NextAppt.ai or because you receive an alert. A booking is complete only when the applicable business or booking provider confirms it. Before relying on a listing or booking, verify material details directly with the provider, including the service, duration, staff member, location, time, price, fees, taxes, cancellation terms, and any eligibility or health restrictions.6. Search Results, Rankings, Sponsored Placement, and Recommendations
Search results may be selected, ranked, filtered, or recommended based on factors such as relevance, service type, duration, time, distance, location, freshness of availability, business information, verification status, historical performance, user preferences, technical reliability, subscription level, promotional placement, or other product factors. Some placements may be sponsored, promoted, premium, or paid and will be identified where required by law. Verification, ranking, a badge, a recommendation, or paid placement is not a guarantee or endorsement of quality, safety, licensing, suitability, or availability.7. Third-Party Websites, Booking Systems, and Services
NextAppt.ai may link to, embed, call, or exchange information with third-party websites, booking systems, maps, payment processors, communications providers, analytics services, CRMs, calendars, or APIs. When you use a third-party service, that third party's own terms and privacy practices may apply. NextAppt.ai is not responsible for a third party's content, security, outages, booking rules, charges, data practices, or conduct. A third-party link or integration does not imply that the third party sponsors or endorses NextAppt.ai or that NextAppt.ai endorses the third party.8. Consumer Accounts
Consumer Users must provide accurate information, maintain control of their email account and login credentials, and promptly notify NextAppt.ai of suspected unauthorized use. NextAppt.ai may use passwordless login codes, secure session cookies, or other authentication methods. You may not impersonate another person, use another person's account without authorization, share verification codes for unauthorized access, or circumvent account-security controls. You are responsible for activity performed through your account to the extent permitted by law.9. Appointment Alerts and Communications
Consumer Users may request alerts about appointment availability, saved searches, businesses, services, or other account activity. Alerts are informational only and do not reserve an appointment. Delivery may be delayed or fail because of email providers, carriers, browsers, devices, spam filtering, network conditions, or third-party services. Transactional and service communications may include login codes, security alerts, account notices, appointment alerts you requested, billing notices, and other messages necessary to provide the Services. Marketing communications are separate. Where required, NextAppt.ai will obtain consent. You may unsubscribe from marketing communications using the instructions provided in the message. Opting out of marketing does not prevent necessary transactional messages.10. Business Listings and Unclaimed Listings
NextAppt.ai may create or display a business listing even if the business has not created a NextAppt account. Listing information may be obtained from the business, booking systems, integrations, publicly available websites or directories, users, or other lawful sources. We may standardize, format, combine, supplement, correct, restrict, or remove listing information to improve consistency, accuracy, safety, legal compliance, or usability. A business may request a correction or claim a listing through available NextAppt processes.11. Business Claims, Verification, and Authority
A Business User who claims or manages a listing represents and warrants that the person is an owner or other authorized representative of the business and has authority to act for and bind the business. We may request evidence of ownership, employment, authorization, domain or email control, identity, licensing, or other verification information. We may approve, reject, suspend, or revoke a claim or verification if information cannot be verified, competing claims exist, the claimant lacks authority, the business violates these Terms, or continued access presents legal, security, fraud, or safety risk. A NextAppt verification badge means only that NextAppt completed the verification steps it selected at the relevant time. It is not a professional credential, license verification, background check, guarantee, or endorsement.12. Business User Responsibilities
Each Business User and the business represented by that Business User is responsible for:- accurate and current business, service, price, staff, availability, promotion, and contact information;
- all required licenses, permits, registrations, insurance, and professional qualifications;
- the quality, safety, legality, and delivery of services;
- customer service, cancellations, refunds, deposits, chargebacks, no-show policies, and taxes;
- obtaining legally required rights, notices, and consents for information supplied to NextAppt.ai;
- ensuring that staff, practitioner, customer, and integration data can lawfully be provided or connected;
- maintaining administrator access and removing access when a representative is no longer authorized;
- protecting connected booking-system credentials and API keys; and
- complying with consumer-protection, advertising, privacy, communications, professional, and other applicable laws.
13. Business Integrations and Credentials
Business Users may be able to connect booking platforms, calendars, CRMs, APIs, widgets, payment systems, websites, or other third-party services. By connecting an integration or submitting credentials, the Business User represents that the business is authorized to access and connect the third-party service and authorizes NextAppt.ai to access, receive, transmit, transform, store, and display integration data as reasonably necessary to provide the requested functionality. NextAppt.ai may disable an integration that creates security, legal, privacy, reliability, or operational risk. Third-party integrations may change or become unavailable without notice.14. User Content and Business Content
Consumer Users and Business Users may submit content such as reviews, ratings, feedback, descriptions, logos, photographs, promotions, staff information, service menus, prices, links, profile information, and other materials ("Content"). You retain ownership of Content you own. You grant NextAppt.ai a worldwide, nonexclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, format, resize, adapt, publish, display, distribute, communicate, index, analyze, and use the Content as reasonably necessary to operate, improve, secure, market, and distribute the Services and, for Business Content, to promote the business and its listing. You represent that you have all rights and permissions necessary to submit the Content and that it is accurate where represented as factual, does not violate law or another person's rights, and does not contain malicious code or unlawful, deceptive, or infringing material. We may moderate, reject, remove, restrict, or label Content, but we are not required to monitor all Content.15. Reviews and Feedback
Reviews and ratings, if offered, must reflect genuine experiences and may not be fabricated, purchased in violation of law or platform rules, submitted by undisclosed conflicted parties, or used to harass or extort. Businesses may not use NextAppt.ai to prohibit or penalize legally protected honest consumer reviews. If you submit product feedback, suggestions, or ideas about NextAppt.ai, you grant NextAppt.ai a perpetual, irrevocable, worldwide, royalty-free right to use and commercialize that feedback without compensation, provided this does not transfer ownership of other Content beyond the licenses stated in these Terms.16. Paid Business Features and Subscriptions
NextAppt.ai may offer verified, premium, advertising, profile, analytics, booking-widget, API, lead-generation, placement, notification, or other paid features. The price, billing frequency, trial terms, included features, renewal terms, and cancellation method shown at the time of purchase control that purchase. If a purchase is described as automatically renewing, you authorize recurring charges until cancellation in accordance with the disclosed terms and applicable law. We may change future prices or feature packages after providing any notice required by law. Nonpayment may result in suspension, downgrade, or removal of paid features. Any separate order form or written business agreement supplements these Terms and controls over these Terms only to the extent it expressly says so.17. Future Consumer Booking and Payment Features
NextAppt.ai may in the future allow Consumer Users to request, reserve, purchase, prepay, or pay deposits for appointments through the platform. If such features are introduced, the checkout flow will disclose the material price, fees, provider, cancellation or refund terms, and any recurring nature required by law. Payment processing may be performed by a third-party payment processor. Unless expressly stated otherwise, the underlying provider remains responsible for delivering the booked service and its provider-specific policies.18. Prohibited Conduct
You may not:- use NextAppt.ai unlawfully or to violate another person's rights;
- impersonate another person or falsely claim authority over a business;
- submit fake listings, appointments, bookings, leads, reviews, or engagement;
- misrepresent prices, availability, credentials, services, promotions, or material terms;
- harass, threaten, discriminate against, defraud, or harm another person;
- upload malware or attempt unauthorized access to accounts, systems, credentials, source code, or data;
- interfere with security, rate limits, authentication, scraping protections, or platform operation;
- use unauthorized automated systems to overload, copy, harvest, or extract nonpublic information from the Services;
- collect personal information from other users without lawful authority;
- resell or republish substantial portions of NextAppt.ai data without permission;
- use NextAppt.ai data to create a competing appointment-availability database or train a model without written authorization; or
- help another person do any prohibited act.
19. Health, Wellness, and Professional Information
NextAppt.ai may list healthcare-adjacent, wellness, beauty, massage, fitness, chiropractic, acupuncture, or other professional services. Information on NextAppt.ai is for discovery and informational purposes and is not medical, legal, financial, or other professional advice. NextAppt.ai is not an emergency service. For a medical emergency, contact 911 or an appropriate emergency provider. Unless NextAppt.ai enters into a written agreement expressly stating otherwise, NextAppt.ai is not agreeing to act as a HIPAA business associate. Do not submit medical records, diagnoses, treatment notes, Social Security numbers, full payment-card numbers, or other unnecessary sensitive information through general search, profile, message, or feedback fields.20. Intellectual Property
The NextAppt.ai Services, including software, design, interfaces, databases, compilations, ranking systems, text, graphics, and NextAppt branding, are owned by or licensed to NextAppt.ai and are protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, revocable, nonexclusive, nontransferable, nonsublicensable right to access and use the Services for their intended purposes. No other rights are granted. You may not use NextAppt.ai names, logos, marks, or trade dress in a way that implies sponsorship, endorsement, or affiliation without permission.21. Copyright Complaints
If you believe material on NextAppt.ai infringes your copyright, send a notice to legal@nextappt.ai identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove allegedly infringing material and may terminate repeat infringers where appropriate.22. Privacy and Data Protection
Our Privacy Policy explains how NextAppt.ai collects, uses, discloses, and retains personal information. Business Users are independently responsible for privacy notices, consents, security, and other legal obligations that apply to information they independently collect or control about customers, employees, contractors, or practitioners. Acceptance of these Terms does not constitute consent to optional marketing, targeted advertising, or other processing for which separate consent is legally required.23. Suspension and Termination
You may stop using NextAppt.ai at any time. Account-deletion options may be provided through account settings or support. We may suspend, restrict, or terminate access when reasonably necessary because of a Terms violation, fraud, suspected fraud, nonpayment, security risk, infringement, unlawful activity, misleading information, unauthorized business claims, abusive conduct, repeated complaints, safety risk, technical necessity, or discontinuation of a feature. Where practical and appropriate, we may provide notice or an opportunity to correct an issue. We may act immediately when needed to protect users, businesses, NextAppt.ai, or others. Provisions that by their nature should survive termination will survive, including payment obligations, licenses, intellectual-property provisions, disclaimers, liability limitations, indemnification, and dispute-resolution provisions.24. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." NextAppt.ai disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, and quality.
NextAppt.ai does not warrant that the Services will be uninterrupted or error-free; that appointment information, prices, rankings, maps, or provider information will be current or correct; that an appointment will remain available; that a provider will honor a listing, offer, or booking; that a provider is licensed, insured, safe, or suitable; or that a service will produce a particular result. Some jurisdictions do not permit certain warranty disclaimers, so these limitations apply only to the extent permitted by law.25. Limitation of Liability
To the maximum extent permitted by law, NextAppt.ai will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, business, goodwill, opportunity, or reputation arising from or relating to the Services, a provider, appointment information, a booking, third-party service, Content, account access, or these Terms.
To the maximum extent permitted by law, NextAppt.ai's aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) $100 or (b) the amount you paid directly to NextAppt.ai during the 12 months before the event giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be excluded or limited.26. Business Indemnification
If you are a Business User or use NextAppt.ai on behalf of a business, you agree, to the maximum extent permitted by law, to defend, indemnify, and hold harmless NextAppt.ai from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from or relating to the business's services, staff, facilities, Content, advertisements, promotions, customer disputes, taxes, booking or cancellation policies, unlawful data practices, infringement, violation of these Terms, or your lack of authority to act for the business. For Consumer Users, any indemnification obligation is limited to claims arising from the Consumer User's unlawful conduct, infringement, fraud, or material violation of these Terms, and only to the extent permitted by law.27. Disputes With Providers or Other Users
Disputes concerning the underlying service, quality of treatment, injuries, cancellations, refunds, provider conduct, or provider-specific charges are generally between the Consumer User and the applicable business or third-party provider. NextAppt.ai may choose to assist with communications or investigate platform misuse, but doing so does not make NextAppt.ai a party to the underlying service transaction or create a duty to resolve the dispute.28. Informal Dispute Resolution
Before starting arbitration or a lawsuit against NextAppt.ai, you agree to send a written notice to legal@nextappt.ai describing your name, account email, relevant business if applicable, the facts and legal basis of the dispute, and the relief requested. The parties will attempt in good faith to resolve the dispute for at least 30 days after a complete notice is received. This requirement does not prevent a party from seeking emergency relief where legally permitted.29. Binding Individual Arbitration and Class-Action Waiver
Important: this section affects your legal rights, including your right to a jury trial and to participate in a class action.
Except for claims eligible for small-claims court and claims for temporary or emergency injunctive relief relating to unauthorized access, intellectual property, or misuse of the Services, disputes arising from or relating to NextAppt.ai, these Terms, or the Services will be resolved through binding individual arbitration.
The Federal Arbitration Act governs this arbitration agreement. Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules for consumer disputes and applicable Commercial Arbitration Rules for business-to-business disputes.
The arbitrator may award the same individual remedies a court could award but may not combine claims or preside over a class, collective, consolidated, coordinated, or representative proceeding.
You and NextAppt.ai each waive the right to a jury trial and the right to participate in a class, collective, consolidated, coordinated, or representative action to the maximum extent permitted by law.
You may opt out of this arbitration agreement by emailing legal@nextappt.ai within 30 days after you first accept these Terms. Include your name, account email, and a clear statement that you are opting out of arbitration. If applicable law makes part of this arbitration section unenforceable for a particular claim or remedy, that claim or remedy will proceed as required by law while the remainder of the section remains effective to the maximum extent permitted.
